Welcome to YTT Estate Sales. By using our online auction platform at yttauction.com, you agree to these Terms and Conditions. Please read them carefully before participating in any auction.
These Terms work together with our Auction Rules & Guidelines, which explain in plain language how our auctions run. Both form part of the agreement between you and YTT Estate Sales; if anything ever appears to conflict, these Terms and Conditions govern.
1. Acceptance of Terms
By creating an account, placing bids, or using any part of our services, you agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.
2. Eligibility
You must be at least 18 years old to use our services. By registering, you represent that you are of legal age and have the legal capacity to enter into binding contracts.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activity under your account
- Notify us immediately of any unauthorized use of your account
4. Bidding
All bids are binding. By placing a bid, you are entering into a legally binding contract to purchase the item if you are the winning bidder.
Bidding Rules
- All bids are final and binding
- Bids cannot be retracted except under limited circumstances and with admin approval
- Bid cancellation requests must be made within the specified time window
- We reserve the right to deny cancellation requests
- Proxy bidding: If you set a maximum bid, our system will automatically bid on your behalf up to that amount
- Bid increments vary based on the current price
Reserve Prices
Some items may have a reserve price. If bidding does not meet the reserve, the item will not be sold. Reserve prices are not disclosed.
5. Winning and Payment
Notification
Winning bidders will be notified via email and/or SMS (if phone number provided) when an auction ends.
Payment Terms
- Payment is due within 12 hours of auction close
- Payment methods: PayPal (credit card, debit card, PayPal balance, and other PayPal-supported methods accepted)
- Total due includes: winning bid + applicable taxes
- Failure to pay may result in account suspension and loss of bidding privileges
Buyer's Premium
There is currently no buyer's premium. If a buyer's premium is introduced in the future, it will be clearly displayed on each auction prior to bidding.
6. Pickup
- Pickup is local only. We do not offer shipping at this time
- All items must be picked up at the designated location during the pickup window stated on each auction (typically a two-day window after the auction closes)
- Pickup information is provided after payment is confirmed; pickup is by appointment
- You may send someone to pick up on your behalf; they must be able to identify the order
- Because our lots come directly from estates that must be cleared promptly, we are unable to store items beyond the pickup window. Items not picked up within the pickup window are forfeited, and no refund is due
- Bring valid ID and order confirmation for pickup
- You are responsible for loading and transporting your items
7. Item Condition
All sales are final. All items are sold "AS IS, WHERE IS."
- We make no warranties, express or implied, regarding item condition
- Item descriptions and photos are provided in good faith as a representation of each lot, but may not capture every detail, flaw, or sign of age and use; dimensions are approximate
- It is your responsibility to review all photos and descriptions before bidding, and to inspect items during preview (if available)
- Ordinary wear and signs of age and use on a pre-owned item are not defects and are not grounds for a refund
- We do not offer returns or exchanges. Refunds are limited to the cases where the sale should not have stood: a lot materially not as described, a duplicate charge, or an error on our end. See our Auction Rules & Guidelines for details. Any accommodation beyond these cases is at our sole discretion and creates no ongoing obligation
8. SMS/Text Communications
Program name: YTT Estate Sales Auction Notifications
By providing your phone number during account registration, you consent to receive SMS/text messages from YTT Estate Sales regarding:
- Winning bid notifications
- Payment due reminders
- Pickup schedule information
- Bid cancellation updates
- Outbid alerts
Message frequency varies based on auction activity (typically 1–5 messages per auction won).
Message and data rates may apply.
To opt out at any time, reply STOP to any message. You will receive one confirmation message and no further messages will be sent.

YTT Estate Sales will not share your phone number with third parties for marketing purposes.
9. Prohibited Conduct
You agree not to:
- Place bids you do not intend to honor
- Create multiple accounts to manipulate bidding
- Collude with other bidders
- Interfere with the operation of the platform
- Use automated systems to place bids
- Harass other users or staff
10. Account Suspension
We reserve the right to suspend or terminate accounts for:
- Non-payment
- Failure to pick up items
- Violation of these Terms
- Fraudulent activity
- Any conduct we deem harmful to our business or other users
11. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid for the specific item in question
- We are not responsible for technical failures, outages, or errors
12. Indemnification
You agree to indemnify and hold harmless YTT Estate Sales, its owners, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
13. Dispute Resolution
Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with California law. You waive your right to participate in class action lawsuits.
14. Changes to Terms
We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the new Terms. We will notify users of significant changes.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
